General Terms and Conditions of Andreas Vent-Schmidt (»Mosebacke Art«)
§1 Validity towards consumers and definitions of terms

The following General Terms and Conditions of Business apply to all deliveries between us and a consumer in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes which can predominantly be attributed neither to his commercial nor his independent professional activity (§ 13 German Civil Law).
§2 Conclusion of a contract, storage of the contract text

The following provisions on the conclusion of a contract apply to orders placed via our websites www.mosebacke.de, www.mosebacke-art.de and www.mosebacke-art.com.

The presentation of services and products on our websites does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation to the consumer to order services. By ordering the desired service, the consumer submits a binding offer to conclude a purchase contract.
The offer is accepted in writing or in text form or by sending the ordered goods within a maximum of 4 weeks. If this period expires without result, the offer is deemed to have been rejected. Acceptance of the offer shall be subject in particular to the availability of sufficient capacity.

Upon receipt of an order in our online store, the following regulations apply:
- The consumer submits a binding contractual offer by successfully completing the order procedure provided in our online store.
- The order is placed in the following steps:
- Selection of the desired product, quantity and, if applicable, further specification,
- Confirmation by clicking on the button »order« or »buy now«,
- Checking the information and adding personal data,
- Selection of the desired payment method, if several are offered.
- The sequence of these steps may vary depending on the specific process.
- Before submitting the binding order, the consumer can return to any previous page by clicking the »back« button on the order pages to check his information and correct it.
- We confirm receipt of the order immediately by an automatically generated e-mail (confirmation of receipt). This does not yet constitute acceptance of the offer. Acceptance of the offer is made in writing (by e-mail), by handing over the goods in our store or by sending the ordered goods within 4 weeks.

§3 Prices, shipping costs, payment, due date

The prices quoted for art prints do not include VAT, as the above-mentioned company is exempt from VAT under § 19 UStG (small business regulation). The prices quoted also do not include shipping costs, as these depend on the shipping destination and can therefore only be determined after the delivery address has been provided.

The consumer has the option of paying by
- Advance payment by bank transfer,
- PayPal,
- PayPal PayLater,
- Mastercard / American Express / Visa (processed through PayPal).

If the consumer has chosen payment in advance, he undertakes to pay the purchase price immediately after conclusion of the contract. Payment must be made by bank transfer to the account specified in the order confirmation.
§4 Delivery
(1)
Delivery is usually made by DHL or another parcel service.
(2)
The risk of accidental loss and accidental deterioration of the goods sold shall pass to the buyer upon dispatch.
§5 Fulfillment
Place of fulfillment is Kieselbach 7c, 04746 Hartha, Germany.
§6 Reservation of non-performance
We reserve the right not to perform the service if the purchase price is not paid in full or on time. In this case, the consumer is entitled to a refund of any payments already made.
§7 Warranty
The statutory warranty regulations apply.
§9 Language of the contract
German is the only language available for the contract.
